Chapter 1: Overall Rental Solicitation Plan
To further standardize the operation of photography services at the Ertaipo Scenic Area, enhance the area’s cultural and tourism‑related amenities, improve the visitor experience and service quality, and eliminate unauthorized photo‑spot setups, unregulated operations, and overcharging, thereby safeguarding the legitimate rights and interests of the scenic area, local businesses, and tourists, Hezhang County Asilixi Grassland Tourism Development Co., Ltd. hereby announces an open public auction for the leasing of photography spots at the Ertaipo Scenic Area’s viewing platforms. The company has established clear leasing criteria, operational requirements, and management regulations. Details of the leasing process are as follows:
1.1 Name of the Rental Solicitation
Public Bidding for the Lease of Photographic Viewing Spots at the Ertaipo Scenic Area Observation Deck
1.2 Lease Terms and Conditions
The subject of this leasing tender is the exclusive photography service location at the Ertaipo Scenic Area’s observation deck, a designated area for commercial photography services within the scenic zone. This site is limited to activities such as taking photographs and videos of visitors, selling photographic prints, and providing basic imaging‑related ancillary services, and will be managed under a unified system of competitive bidding, standardized leasing, and centralized administration.

1.3 Basic Requirements for Tenants (Bidders)
1.3.1 If the bidder is an individual, they must attend the bidding session with their original valid ID card and proof of payment of the bid deposit. If the bidder is a sole proprietor or a legal entity, they must present their business license, the legal representative’s original ID card, and proof of deposit payment to participate in the bidding.
1.3.2 The lessee shall abide by laws and regulations, operate with integrity, provide courteous and standardized services, clearly display prices, and strictly prohibit any unlawful business practices such as overcharging, deceiving customers, imposing arbitrary fees, or defrauding tourists, while voluntarily complying with the scenic area’s unified management.
1.3.3 Strictly comply with the scenic area’s regional management regulations: business activities shall be conducted exclusively within the designated photography zones; unauthorized expansion of the operating area or cross‑zone operations are prohibited, as is any unauthorized modification of business offerings or operation beyond the approved scope.
1.3.4 During the operating period, strictly implement the “three‑responsibility‑for‑the‑area‑in‑front‑of‑the‑door” system for environmental hygiene; promptly remove waste and contaminants generated by operations; maintain cleanliness and tidiness at the site and in its surrounding area; and preserve the overall aesthetic of the scenic area.
1.3.5 It is strictly prohibited to sublease, lend, or transfer the operating rights of photography locations without authorization, and it is also strictly forbidden to modify the facilities at these locations or alter the site layout on your own initiative.
1.4 Registration and Deposit Payment
1.4.1 Registration Period: From July 12 to July 15, 2026, between 9:00 a.m. and 12:00 p.m. Eligible prospective lessees may visit the scenic area office to complete registration.
1.4.2 Bidding Deposit: The bidding deposit for each photography location in this round is uniformly set at RMB 5,000 per location. Prospective bidders must remit the full amount prior to the registration deadline; failure to pay the deposit will be deemed an automatic waiver of bidding eligibility.

Chapter 2: Rental Guidelines
2.1 General Provisions
2.1.1 This plan is formulated by Hezhang County Xilixi Grassland Tourism Development Co., Ltd. The current call for leasing photography sites will be conducted through an open public auction, with no restrictions based on geographic location or household registration. Eligible natural persons, individual business households, and corporate legal entities may voluntarily apply to participate.
2.1.2 All bidders participating in this auction shall be deemed to have fully acknowledged and voluntarily complied with all provisions of this plan and the scenic area’s management regulations, and to have voluntarily assumed operational responsibilities and associated risks.
2.1.3 Deposit Management Rules: The deposits of unsuccessful bidders shall be refunded in full, without interest, within three business days after the auction concludes; the deposit of the successful bidder may be applied toward rent and the performance bond, with any remaining balance to be paid in a lump sum upon signing the contract. No refund shall be made if any of the following circumstances apply:
⑴ During the bidding process, there are instances of bid-rigging, falsification, or violations of laws and regulations;
⑵ Those who leave the auction prematurely or voluntarily withdraw from the bidding;
⑶ After the transaction is concluded, refusing to sign the lease agreement without justifiable reason or renouncing the right to lease;
⑷ Providing false information to fraudulently obtain bidding or transaction qualifications;
⑸ Interfering with or disrupting the normal conduct of bidding activities.
2.1.4 The operating rights for the photography site under this agreement are exclusively vested in the named party; without Party A’s prior written consent, subletting, partial subletting, or lending the site to others for operation is strictly prohibited, and any disguised transfer of such operating rights is likewise forbidden.
2.1.5 The lessee shall strictly comply with the scenic area’s regulations on vehicle access and operating hours, and shall abide by the unified management of the scenic area’s security, operations, and sanitation departments. Unauthorized passage or unauthorized parking is strictly prohibited.
2.1.6 During the operating period, the sale, display, or exhibition of kite-related products and associated ancillary businesses are strictly prohibited; unauthorized stalls and mobile operations are also forbidden, as is the conduct of any business activities that are expressly banned.
Chapter 3: Principles of Transaction and Rental Management Discipline
3.1 Principles of Transaction
3.1.1 This auction shall be conducted on the basis of open bidding and the highest‑bidder‑wins principle; the bidder submitting the highest valid bid shall be deemed the successful lessee. If no bids are received, the subject property shall be treated as having failed to sell. If only one bidder registers, the transaction shall proceed directly at the reserve price.
3.1.2 If the highest‑ranking successful bidder forfeits the transaction or refuses to sign the contract, the entire deposit shall be forfeited, and the right to conclude the transaction shall pass to the next highest bidder.
3.1.3 In the event of any violation of regulations, unfair competition, or significant unforeseen circumstances during the bidding process, the lessor shall have the right to suspend or terminate this bidding activity.
3.2 Rental Solicitation Discipline and Venue Guidelines
3.2.1 This auction will be conducted in a fully open, fair, impartial, and transparent manner, in strict compliance with applicable laws and regulations as well as the scenic area’s management rules, and will strictly prohibit any acts such as private collusion, malicious bidding, or disruption of order.
3.2.2 Bidding participants must check in and enter the venue on time, take their seats in an orderly manner, and comply with the instructions of on-site staff. The venue must remain quiet and well-organized; loud talking, unauthorized seat changes, private discussions or price negotiations, and unauthorized audio or video recording are prohibited. Any behavior that disrupts the order of the venue is strictly forbidden.
Chapter 4: Procedure for Public Auction Rental Procurement
4.1 Upon arrival, bidders shall, in turn, complete check-in, identity verification, and document review, and take their seats at the designated locations.
4.2 The host announces the official commencement of the public auction for leasing photography spots at this scenic area.
4.3 Staff shall introduce the basic details of the photography location, its scope of operations, bidding rules, venue etiquette, and management requirements.
4.4 The list of eligible bidders shall be publicly announced, and identification documents, proof of deposit payment, and other relevant materials shall be verified on-site.
4.5 On-site Open Auction: Bidding shall be conducted based on a reserve price of RMB 10,000 per site. The minimum bid increment per round shall be no less than RMB 500. Only bids equal to or exceeding the reserve price shall be deemed valid, and the highest final bid shall prevail.
4.6 Confirmation of the transaction outcome: The leasing entity and the successful lessee shall sign on-site to confirm the bidding results.
4.7 The host announces the conclusion of the auction, and a “Bidding Transaction Confirmation” is issued on-site.
4.8 The successful bidder shall, within three business days after the auction concludes, present the Transaction Confirmation and proof of payment to the scenic area company to sign the formal lease agreement and pay all outstanding rent and performance fees. Failure to do so will be deemed a voluntary waiver, and the security deposit will not be refunded.
Chapter 5: Key Provisions of the Lease Agreement
5.1 Lease Term
The lease term for this photography location is 10 months, with the exact start and end dates subject to the final lease agreement.
5.2 Fee Payment Requirements
The lessee shall remit the full amount of rent and the operating performance bond within three days of signing the contract. Failure to pay by the deadline shall be deemed a voluntary waiver of the lease, with no refund of the deposit; any resulting losses shall be borne solely by the lessee. During the lease term, all expenses related to electricity, site maintenance, environmental sanitation, facility repairs, and other such costs shall be borne by the lessee.
5.3 Rights and Obligations of Party A (the Leasing Entity)
5.3.1 Responsible for designating on-site exclusive operating zones for photography and clearly defining the operational boundaries.
5.3.2 Ensure that tenants may enter and conduct business as scheduled, and grant access to the scenic area.
5.3.3 The party shall hold lawful ownership and management rights over the designated premises and shall be entitled to supervise, inspect, and manage the lessee’s business operations, site usage, environmental hygiene, and compliance with industry-specific regulations.
5.3.4 Review and supervise the lessee’s plans for site modifications, facility additions, and other related works, and strictly prohibit any unauthorized alterations.
5.4 Rights and Obligations of Party B (Lessee)
5.4.1 Photography operations must be conducted strictly within the designated area; no activities may exceed the authorized scope or span multiple regions, and no unauthorized changes to the scope of business shall be made.
5.4.2 Adhere to clearly marked pricing and honest business practices, provide courteous service, and strictly prohibit illegal behaviors such as overcharging, deceiving customers, and imposing arbitrary fees; voluntarily accept oversight from the scenic area and tourists.
5.4.3 Strictly implement the “three responsibilities” system for the area in front of one’s premises, promptly remove business waste and debris, maintain a clean and tidy environment, and safeguard the scenic area’s ecological integrity and environmental hygiene.
5.4.4 Strictly comply with the scenic area’s vehicle access regulations: vehicles may enter or exit only before 8:00 a.m. and after 7:00 p.m. daily. During peak visitor periods, occupying roadways, cutting in line, and unauthorized parking are strictly prohibited; all users must follow the scenic area’s traffic management guidelines.
5.4.5 During the lease term, the lessee shall not privately assign, sublease, or lend the premises; nor may the lessee unilaterally terminate the contract. In the event of unauthorized breach of contract, Party A shall not refund the security deposit.
5.5 Refund and Deduction of the Security Deposit
Upon expiration of the lease term, if the lessee has fully complied with the contractual provisions, maintained lawful operations, sustained no damage to facilities, and resolved all complaints and disputes, the performance bond shall be refunded in full without interest. Should any damage be caused to the premises or facilities, or if any violation of the contract occurs, Party A shall be entitled to deduct from the bond the costs of repair and any applicable liquidated damages; any shortfall shall be recovered in accordance with the law.
5.6 Liability for Breach of Contract
5.6.1 If the lessee engages in illegal business practices, exploits or deceives customers, or is found to have committed violations upon inspection by the competent authorities or the scenic area, the lessee shall unconditionally cease operations, and Party A shall not refund any fees.
5.6.2 For vehicles entering or exiting in violation of regulations, or parked illegally, a first-time violation will result in a deduction of RMB 500 from the security deposit; a second violation will incur a deduction of RMB 2,000; and a third violation will lead to immediate expulsion, forfeiture of all fees, and termination of the contract.
5.6.3 If the business premises are dirty, disorganized, and fail to meet hygiene standards, a first-time violation will result in corrective action and a deduction of RMB 500 from the security deposit; a second violation will incur a deduction of RMB 2,000; and a third violation will lead to immediate termination of the contract, with no refund provided.
5.6.4 If either party unilaterally terminates the contract without just cause, it shall provide the other party with seven days’ prior written notice. The breaching party shall pay the non-breaching party a penalty equal to 20% of the total rent stipulated in the contract.
5.7 Force Majeure
In the event that operations are suspended or losses are incurred due to force majeure events such as earthquakes, flash floods, fires, extreme weather, policy changes, or closure and control measures at the scenic area, rent shall not be refunded, and the lessee shall not unreasonably seek accountability or engage in disruptive behavior.
5.8 Other Agreements
5.8.1 Upon expiration of the lease term, the lessee shall remove all personal equipment and belongings. Any items left behind after the deadline shall be deemed abandoned, and the lessee shall be responsible for any damage or loss.
5.8.2 Any matters not covered in this Agreement shall be determined through consultation between Party A and Party B; any supplementary agreements and the formal lease contract shall have the same legal effect as this Agreement.
5.8.3 In the event of a dispute arising during the performance of this contract, the parties shall endeavor to resolve it through amicable consultation. If no agreement is reached through consultation, either party may file a lawsuit with the local people’s court.
5.8.4 This plan shall take effect from the date of its promulgation, and shall be interpreted by Hezhang County Asilixi Grassland Tourism Development Co., Ltd.
